Terms of use
Effective 2026
1. Agreement
These terms apply to the Crew Guard Android app and this website, provided by Maritime TOP Ltd. By using the app you agree to these terms and to our privacy policy.
2. Important safety notice
Crew Guard is an extra aid for noticing that a crew member may have gone overboard. It is not a certified man-overboard device, a personal locator beacon or an AIS/DSC MOB device, and it does not replace a lifejacket, a harness and jackstays, a proper watch or good seamanship.
The app depends on the phones' radios, batteries and operating systems, which can fail, be out of range or stop the app without warning. It can miss a man overboard, raise the alarm late, or raise a false alarm. You remain solely responsible for the safety of your vessel, its crew and others.
3. The service
Aboard, the app works between the crew's phones over Bluetooth and Wi-Fi, without our server. Alerts to watchers go over the internet and arrive only while a phone aboard has a connection; they can be late or not arrive at all. We may change, suspend or discontinue features, and we do not guarantee uninterrupted or error-free operation.
4. Premium subscription
Everything aboard is free. Watching a crew needs a Premium subscription, purchased through Google Play on the watcher's phone. Prices, billing, renewal, cancellation and refunds are handled by Google Play under its terms. You can cancel at any time in Google Play; the subscription then remains active until the end of the paid period.
5. Joining a crew and invite links
A crew's QR code lets a phone join that crew and see its members' names and the boat's position while the guard is on. Show it only to your crew. A watcher invite link lets one person follow the crew's alarms; it stops working after 24 hours or one use, and any crew member can remove a watcher.
6. Acceptable use
You must not use the app unlawfully, or to follow people who have not agreed to be part of your crew.
7. Intellectual property
The app and this website, including their software, text, graphics, sounds and trademarks, belong to Maritime TOP Ltd or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose.
8. Third-party services
The app uses Google services (Play services, Nearby Connections, Firebase). Their use is subject to their own terms.
9. Disclaimer
To the extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy of positions or timely delivery of alarms.
10. Limitation of liability
To the extent permitted by law, we are not liable for any loss or damage, including personal injury, loss of life, damage to vessels or property, or indirect or consequential loss, arising from the use of or inability to use the app, including missed, delayed or false alarms. Nothing in these terms limits liability that cannot be limited by law, such as for intent, gross negligence, or injury to life, body or health.
11. Changes
We may update these terms. We will publish the new version on this page; continued use after the change means you accept it.
12. Governing law
These terms are governed by the laws of the United States. Mandatory consumer protection rules of your country of residence remain unaffected.
